It is important for tenants-to-be to pay a little more attention to "Tenancy Agreement" before signing. Of course, in most cases tenancy agreements are rather one sided. It is a Landlord's market especially where lucrative locations are concerned. Yet it is still prudent to iron out, as far as possible what entails after you signed on the dotted lines.
It is a common clause that states that "The Tenant" is expected to return the unit in its "Original Condition with fair wear and tear excepted". What is not known is the surrounding conditions for which you are to return the unit to its original conditions. Many tenants quitting their premises are surprised by the sometimes over stringent requirements put forth by landlords, and this could translate into hefty hidden costs that you may have to bear. BE AWARE that sometimes the reinstatement costs can run up to tens of thousand dollars due to such conditions.
Commercial units usually requires works to be done only after all shops are closed, and that means working the midnight shift. Some commercial malls do not allow bins to be brought into their premises, and this means multiple trips by the contractors lorry. You are often require to protect the floors of common areas leading from your shop to the cargo lift or the location where you dump the debris. If your works take several days, you will have to lay floor protection material over and over again daily. Hoardings around the shops is a common thing these days. What may be most horrifying is some landlords require you to put up performance bonds plus cash deposits, not withstanding you also have your security deposits placed with them. Some quitting tenants found themselves UNABLE TO QUIT.
So, before you sign any tenancy, maybe you can ask the landlord for a copy of "Reinstatement Requirements" and have them attached to the tenancy agreement just in case unreasonable additional conditions are imposed.
